AN ACT TO AMEND SECTION 56-3-1250, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO MOTOR VEHICLE REGISTRATION CARDS, SO AS TO REDUCE THE PENALTY FOR FAILURE OF THE OWNER TO SIGN THE REGISTRATION CARD IN THE SPACE PROVIDED; AND TO AMEND SECTION 56-3-375, RELATING TO THE ESTABLISHMENT OF A SYSTEM OF REGISTRATION OF MOTOR VEHICLES ON A MONTHLY BASIS, SO AS TO PROVIDE THAT THIS SECTION DOES NOT REQUIRE A PERSON TO MAINTAIN REGISTRATION AND LICENSING FOR A VEHICLE THAT CEASES TO BE OPERATED, IS IN STORAGE, OR IS INOPERABLE AND TO PROVIDE FOR THE MANNER IN WHICH THESE VEHICLES MAY BE REREGISTERED.
Be it enacted by the General Assembly of the State of South Carolina:
Penalty reduced
SECTION 1. Section 56-3-1250 of the 1976 Code is amended to read:
"Section 56-3-1250. The department, upon registering and licensing a vehicle, shall issue to the owner of the vehicle a registration card containing upon the face of the card the date issued, the name and address of the owner, including the county in which the owner resides, the registration and license number assigned to the vehicle, and that other description of the vehicle as may be determined by the department. The registration card must be delivered to the owner, and the owner, upon receipt of it, shall write his signature on it with pen and ink in the space provided. Every registration card must at all times be carried by the person driving or in control of the vehicle, who shall display it upon demand of a police officer or any other person authorized by law to examine registration cards.
Notwithstanding the provisions of Section 56-3-2520 or any other provisions of law, the penalty for the failure of the owner to sign the registration card with pen and ink in the space provided is a fine of ten dollars."
Registration and licensing not required
SECTION 2. Section 56-3-375 of the 1976 Code is amended by adding at the end:
"This section does not require a person to maintain registration and licensing for a vehicle that ceases to be operated, is in storage, or is inoperable. A person may subsequently register and license a vehicle that is in storage, is not being operated, or is inoperable upon payment of a five-dollar fee. However, the vehicle may be reregistered at the five-dollar fee only upon proof that the motor vehicle is insured and if the previous registration and licensing of the vehicle has not violated Sections 56-10-240 and 56-10-245."
Time effective
SECTION 3. This act takes effect upon approval by the Governor.
