To whom was referred a Bill (S. 869), to change South Carolina State College to South Carolina State University, etc., respectfully

REPORT:

That they have duly and carefully considered the same, and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by adding a new section to be appropriately numbered which shall read:

/SECTION __. In addition to other provisions of law applicable to South Carolina State University, it and its board must specifically comply with the provisions of Sections 59-103-35 and 59-103-60./

Amend title to conform.

STATEMENT OF ESTIMATED FISCAL IMPACT

S. 869 changes the name of South Carolina State College to South Carolina State University. This change would be effective July 1, 1991.

This bill provides for a change in the name of the institution, with no provisions for change in mission and/or degrees offered. The change in name would have no fiscal impact on the General Fund.

The change in status from college to university expands the opportunity for the institution to request additional programs, consequently revising it's mission. According to 59-103-60 of the South Carolina Code of Laws, however, "The Commission (on Higher Education) shall make such recommendations to the State Budget and Control Board and the General Assembly as to policies, programs, curricula, facilities, administration and financing of all state-supported institutions of higher learning as may be considered desirable." Section 59-103-35 further states "No new program shall be undertaken by any state-supported institution of higher learning without the approval of the Commission." Any future impact would, therefore, be a result of new programs approved by The Commission on Higher Education, not a change in name.

A BILL

TO CHANGE SOUTH CAROLINA STATE COLLEGE TO SOUTH CAROLINA STATE UNIVERSITY, EFFECTIVE JULY 1, 1991.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. South Carolina State College is changed to South Carolina State University, effective July 1, 1991, and wherever in the 1976 Code or in any other provision of law the name South Carolina State College appears, it must be construed to mean South Carolina State University.

SECTION 2. This act takes effect upon approval by the Governor.
