A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 8-11-15 SO AS TO PROVIDE FOR A PROCEDURE FOR STATE OFFICERS AND EMPLOYEES TO FOLLOW WHEN AN EMERGENCY DECLARATION IS ISSUED BY THE GOVERNOR WHICH CLOSES STATE OFFICES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 8-11-15. (A) Employees may be excused for up to two days a year from their job duties when their state office is closed as a result of the Governor's declaration of emergency due to inclement weather or some other unsafe condition. (B) If offices are closed more than two days a year, the hazardous weather policy adopted by the Budget and Control Board as part of the State Personnel Regulations applies.

(C) Nothing in this section may be construed to limit the authority of the Governor or state agency head from requiring personnel who provide direct care services to remain or report to work."

SECTION 2. This act takes effect upon approval by the Governor.
