To whom was referred a Bill (S. 1144), to amend Section 48-9-610, as amended, Code of Laws of South Carolina, 1976, relating to the appointment of commissioners to serve with elected commissioners as the governing body of a soil and water conservation district, etc., respectfully

A BILL

TO AMEND SECTION 48-9-610, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE APPOINTMENT OF COMMISSIONERS TO SERVE WITH ELECTED COMMISSIONERS AS THE GOVERNING BODY OF A SOIL AND WATER CONSERVATION DISTRICT, SO AS TO AUTHORIZE THE APPOINTMENT OF A MAXIMUM OF TWO ADDITIONAL COMMISSIONERS; AND TO AMEND SECTION 48-9-1210, AS AMENDED, RELATING TO THE QUALIFICATIONS OF APPOINTED COMMISSIONERS, SO AS TO DELETE THE REFERENCE TO THE NUMBER OF COMMISSIONERS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 48-9-610 of the 1976 Code, as last amended by Section 1188, Act 181 of 1993, is further amended to read:

"Section 48-9-610. If the department shall determine determines that the operation of the proposed district within the defined boundaries is administratively practicable and feasible, it shall appoint two commissioners to act with the three commissioners elected as provided in Article 11 of this chapter as the governing body of the district. Upon the request of the governing body of a district, the department may appoint a maximum of two additional commissioners to serve with the five commissioners provided in this section on the governing body for terms of four years."

SECTION 2. Section 48-9-1210 of the 1976 Code, as last amended by Section 1191, Act 181 of 1993, is further amended to read:

"Section 48-9-1210. The two commissioners appointed by the board shall must be persons who are by training and experience qualified to perform the specialized skilled services which will be required of them in the performance of their duties under this chapter."

SECTION 3. This act takes effect July 1, 1994.
