TO AMEND SECTION 10-1-160 OF THE CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE DISPLAY OF THE STATE FLAG ATOP THE STATE HOUSE, SO AS TO REQUIRE THAT THE UNITED STATES FLAG AND THE STATE FLAG SHALL BE DISPLAYED FROM STAFFS ATOP OR NEAR THE MAIN ENTRANCES OF ALL STATE-OWNED BUILDINGS, EXCEPT WHEN TWO OR MORE STATE-OWNED BUILDINGS ARE ADJACENT OR CONTIGUOUS TO EACH OTHER OR WHEN ONE STATE AGENCY IS HOUSED IN MORE THAN ONE BUILDING ON THE SAME GROUNDS, IN WHICH CASES THE FLAGS SHALL BE DISPLAYED FROM A STAFF IN AN APPROPRIATE PLACE OF HONOR IN ONE LOCATION ONLY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 10-1-160 of the 1976 Code is amended to read:
"Section 10-1-160. (A) The flag of the United States of America and the State state flag shall be displayed daily, except in rainy weather, from a staff upon atop the State House and from a staff atop all other state-owned buildings, subject to subsection (B) below.
(B)(1) When the top of a building is not the most prominent location to display the flags, the flags shall be displayed from a staff in an appropriate place of honor at or near the main public entrance. (2) When two or more state-owned buildings are adjacent or contiguous to each other, the flags shall be displayed from a staff in an appropriate place of honor in one location only.
(3) When one state agency is housed in more than one building on the same grounds, the flags shall be displayed from a staff in an appropriate place of honor in one location only.
(C) Subsection (B) above shall not apply to the State Capitol grounds.
(D) The State Budget and Control Board shall purchase a suitable flag flags to be displayed from the staff atop the State House and cause it them to be displayed, the expense to be borne out of the funds provided for maintenance. The General Assembly shall provide funding for the flags to be displayed atop the other state-owned buildings."
SECTION 2. This act takes effect upon approval by the Governor.
