A BILL

TO AMEND SECTION 59-54-20, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE STATE COUNCIL ON VOCATIONAL AND TECHNICAL EDUCATION AND THE STATE OCCUPATIONAL TRAINING ADVISORY COMMITTEE, SO AS TO PROVIDE THAT A MAJORITY OF THE MEMBERS OF THE STATE COUNCIL MUST NOT BE MEMBERS OF THE COMMISSION ON HIGHER EDUCATION AND TO PROVIDE THAT A FULL-TIME EXECUTIVE DIRECTOR OF THE STATE COUNCIL SHALL BE APPOINTED BY THE COUNCIL TO SERVE AT ITS PLEASURE; BY ADDING SECTION 59-54-25 SO AS TO PROVIDE THAT ALL RECOMMENDATIONS OF THE STATE COUNCIL FOR THE IMPROVEMENT OF VOCATIONAL EDUCATION PROGRAMS SHALL BE MADE TO THE STATE BOARD OF EDUCATION, TO PROVIDE THAT WRITTEN CORRESPONDENCE FROM THE STATE COUNCIL OR ITS STAFF TO LOCAL SCHOOL DISTRICTS MUST BE REVIEWED AND APPROVED BY THE STATE DEPARTMENT OF EDUCATION, AND TO PROVIDE FOR THE MANNER IN WHICH ON-SITE EVALUATIONS BY MEMBERS OF THE STATE COUNCIL SHALL BE ACCOMPLISHED; AND BY ADDING SECTION 59-54-35 SO AS TO PROVIDE THAT THE PRESIDENT OF THE SOUTH CAROLINA VOCATIONAL DIRECTORS ASSOCIATION SHALL RECEIVE NOTIFICATION OF ALL MEETINGS OF THE STATE COUNCIL TOGETHER WITH COPIES OF MEETING MATERIALS AND CORRESPONDENCE AND THAT THE PRESIDENT OF THE SOUTH CAROLINA VOCATIONAL DIRECTORS ASSOCIATION SHALL ADDRESS THE STATE COUNCIL ANNUALLY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 59-54-20 of the 1976 Code, as amended by Section 82A, Part II of Act 164 of 1993, is further amended to read:

"Section 59-54-20. (A) The State Council on Vocational and Technical Education membership shall comply with all requirements of Section 112 of the Carl D. Perkins Vocational and Applied Technology Education Act of 1990. In addition, a majority of the council membership appointed by the Governor must not be members of the Commission on Higher Education, provided that and the members of the commission serving on the State Council must meet the federal requirements of the establishment of the council. Further, at least four members of the council must represent secondary vocational education.

(B) An executive director of the State Council on Vocational and Technical Education shall be appointed by the council to serve at its pleasure. The executive director shall report to the chairman of the State Council and devote full time to his duties as executive director.

(C) The Commission on Higher Education shall serve as the State Occupational Training Advisory Committee and in this regard shall make recommendations to the State Board of Education, the State Board for Technical and Comprehensive Education, the Governor's office, and the public for:

(1) improving the coordination among the state's plans and programs for adult vocational education, adult basic and adult secondary education, post-secondary technical education, and secondary vocational education;

(2) assuring the compatibility of these educational plans and programs with the state's economic development strategies;

(3) improving the articulation between secondary vocational education and post-secondary technical education and between post-secondary technical education and four-year degree programs;

(4) improving service to groups or communities in the State which are unserved or underserved and need additional training and education to be employed or to move into the work force and off of public assistance;

(5) improving the accountability systems and effectiveness of the adult vocational education, adult basic and adult secondary education, post-secondary technical education, and secondary vocational education programs;

(6) improving the implementation of the South Carolina Employment Revitalization Act of 1986."

SECTION 2. The 1976 Code is amended by adding:

"Section 59-54-25. (A) All recommendations of the State Council for the improvement of vocational educational programs shall be made to the State Board of Education.

(B) Written correspondence from the State Council or its staff to local school districts must be reviewed and approved by the State Department of Education prior to being sent or distributed to its addressee.

(C) On-site evaluations by members of the State Council shall be accomplished through participation on State Department of Education teams conducting current vocational evaluations or by review of written reports of such State Department of Education teams concerning these evaluations."

SECTION 3. The 1976 Code is amended by adding:

"Section 59-54-35. (A) The President of the South Carolina Vocational Directors Association shall receive prior notification of all meetings of the State Council together with copies of all meeting materials and correspondence which is a matter of public record under the Freedom of Information Act.

(B) The President of the South Carolina Vocational Directors Association shall address the state council annually on the state of vocational education in South Carolina at a time to be determined by the State Council."

SECTION 4. This act takes effect upon approval by the Governor.
