To whom was referred a Bill (S. 1368), to amend the Code of Laws of South Carolina, 1976, by adding Section 5-31-60 so as to prohibit a municipality from discontinuing sewer service to a person who chooses to disconnect from that municipality's water system, etc., respectfully
That they have duly and carefully considered the same, and recommend that the same do pass with amendment:
Amend the bill, as and if amended, page 1, beginning on line 27, in Section 5-31-60 (A), as contained in SECTION 1, by striking lines 27 through 29 and inserting therein the following:
/Chapter 7 of this title, do not apply to an individual who disconnects from a municipality's water system and installs a groundwater well located outside of a municipality as his only source of water./.
Amend title to conform.

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 5-31-60 SO AS TO PROHIBIT A MUNICIPALITY FROM DISCONTINUING SEWER SERVICE TO A PERSON WHO CHOOSES TO DISCONNECT FROM THAT MUNICIPALITY'S WATER SYSTEM, AND PROHIBIT THAT MUNICIPALITY FROM CHARGING AN ASSESSMENT OR FEE TO FORMER CUSTOMERS LOCATED OUTSIDE ITS CORPORATE LIMITS; AND BY ADDING SECTION 44-55-44 SO AS TO EXEMPT FROM REGULATION GROUNDWATER WELLS FOR USE AS A PERSON'S ONLY SOURCE OF WATER.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 5-31-60. (A) The requirements of this chapter or Chapter 7 of this title, do not apply to a person who chooses to disconnect from a municipality's water system and installs a groundwater well as their only source of water.
(B) No assessment or fee may be charged by the municipality when the person chose to disconnect from the water system as provided in subsection (A).
(C) A municipality may not discontinue sewer service to a person because he chooses to disconnect from the municipality's water system."
SECTION 2. The 1976 Code is amended by adding:
"Section 44-55-44. The requirements of Section 44-55-40 and related regulations do not apply to a groundwater well located outside of a municipality when the well is the only source for water."
SECTION 3. This act takes effect upon approval by the Governor.
