A BILL

TO AMEND SECTION 20-7-870, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE COURT'S AUTHORITY TO COMMIT A RESPONDENT TO JAIL FOR FAILURE TO OBEY AN ORDER FOR SUPPORT SO AS TO REQUIRE THE COURT TO ISSUE A WARRANT AND TO REPEAL SECTION 20-7-930 RELATING TO THE COURT'S AUTHORITY TO PLACE A RESPONDENT ON PROBATION AFTER REFUSING TO OBEY AN ORDER FOR SUPPORT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 20-7-870 of the 1976 Code is amended to read:

"Section 20-7-870. Where a respondent shall neglect neglects or refuse refuses to obey an order for support or upon agreement signed by the respondent and approved by the court, and the court is satisfied thereof by competent proof, it may shall, with or without notice, issue a warrant to commit the respondent to jail until the order is obeyed or until the respondent is discharged by law."

SECTION 2. Section 20-7-930 of the 1976 Code is repealed.

SECTION 3. This act takes effect upon approval by the Governor.
