A BILL

TO AMEND SECTION 59-11-20 OF THE CODE OF LAWS OF SOUTH CAROLINA, 1976, AS AMENDED, RELATING TO THE ESTABLISHMENT OF THE SOUTH CAROLINA EDUCATION COUNCIL, SO AS TO PROVIDE THAT ONE MEMBER FROM EACH HOUSE OF THE GENERAL ASSEMBLY BE APPOINTED TO SERVE ON THE SOUTH CAROLINA EDUCATION COUNCIL AND THAT THE APPOINTMENTS BE MADE BY THE PRESIDING OFFICER OF EACH HOUSE; AND TO ADD CHAPTER 12 TO TITLE 59, SO AS TO ESTABLISH THAT SOUTH CAROLINA IS A PARTY TO A COMPACT ESTABLISHED BY ACT NUMBER 860 OF 1948, A JOINT RESOLUTION, AND ENTERED INTO BY THE SOUTHERN STATES THROUGH THEIR RESPECTIVE GOVERNORS, RELATIVE TO THE PLANNING, ACQUISITION, ESTABLISHMENT AND MAINTENANCE OF JOINTLY OWNED AND OPERATED REGIONAL EDUCATION INSTITUTIONS, TO PROVIDE THAT ALL AGREEMENTS, OBLIGATIONS AND COVENANTS THEREIN ARE BINDING ON THE STATE OF SOUTH CAROLINA, AND TO PROVIDE FOR REPRESENTATION ON THE COMPACT'S BOARD OF CONTROL OF SOUTHERN REGIONAL EDUCATION AND TO ESTABLISH HOW THOSE REPRESENTATIVES ARE CHOSEN.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 59-11-20 of the 1976 Code, as last amended by Section 6 of Act Number 248 of 1991, is amended to read:

"Section 59-11-20. There is hereby established the South Carolina Education Council composed of the members of the Educational Commission of the states representing this State. The Educational Commission representing South Carolina shall be composed of the following: The Governor, one member from each House of the General Assembly who shall be appointed by the presiding officer, and four other members who shall be appointed by the Governor for terms of four years. The Governor shall be chairman unless he shall designate another member to act in his stead. The Council council shall meet on the call of the chairman or at the request of a majority of the members, but in any event the Council council shall meet not less than three times in each year. The Council council may consider any and all matters relating to public educational policy and any matters relating to recommendations of the Educational Commission of the states and the activities of the members in representing this State thereon."

SECTION 2. Title 59 of the 1976 Code is amended by adding:

"Chapter 12

Board of Control for Southern

Regional Education

Section 59-12-10. It is hereby established that South Carolina is a party to a compact established by Act Number 860 of 1948, a joint resolution, and entered into by the states of South Carolina, Georgia, Florida, Alabama, Tennessee and other Southern states, through their respective Governors, relative to the planning, acquisition, establishment and maintenance of jointly owned and operated regional educational institutions, and that the agreements, covenants and obligations therein are binding upon the state of South Carolina.

Section 59-12-20. As provided in the compact between the Southern states, the Board of Control for Southern Regional Education is established. South Carolina shall be represented on this board by the Governor of this state ex officio and four members appointed by the Governor to serve four year terms, at least one of whom shall be from the field of education and at least one shall be a member of the General Assembly."

SECTION 3. This act takes effect upon approval by the Governor.
