A BILL

TO AMEND SECTION 50-17-685, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO TURTLE EXCLUDER DEVICES, SO AS TO AUTHORIZE THE WILDLIFE AND MARINE RESOURCES DEPARTMENT TO REQUIRE THE DEVICES TO BE USED IN CERTAIN WATERS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 50-17-685 of the 1976 Code is amended to read:

"Section 50-17-685. A turtle excluder device must be used in trawl nets in state waters under the same conditions required by federal regulations. However, the Wildlife and Marine Resources Department must may require that a turtle excluder device must be used in all state waters inshore and seaward of the COLREGs demarcation line. The department shall follow the federal enforcement guidelines when enforcing any state turtle excluder device regulations, except as otherwise provided in this section."

SECTION 2. This act takes effect upon approval by the Governor.
