TO AMEND SECTION 61-3-740, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO SUSPENSION OR REVOCATION OF LICENSES ISSUED BY THE ALCOHOLIC BEVERAGE CONTROL COMMISSION, AND SECTION 61-13-290, RELATING TO THE UNLAWFUL SALE OF ALCOHOLIC LIQUOR TO A PERSON UNDER TWENTY-ONE YEARS OF AGE, SO AS TO PROVIDE FOR REVOCATION OF A LICENSE FOR A VIOLATION OF SECTION 61-13-290.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 61-3-740 of the 1976 Code is amended to read:
"Section 61-3-740. (A) The commission may suspend or revoke any a license issued by it if it be is of the opinion that one or both of the following apply:
(1) The licensee is not a suitable person to hold such the license; or.
(2) The store or place of business occupied by the licensee is not a suitable place.
(B) The commission shall revoke a license it issued to a person convicted under Section 61-13-290, unlawful sale of alcoholic liquor to a person under twenty-one years of age."
SECTION 2. Section 61-13-290 of the 1976 Code is amended to read:
"Section 61-13-290. (A) Any A person engaged in the sale of alcoholic liquors who knowingly sells the liquors to a person under the age of twenty-one years is guilty of a misdemeanor and must be, upon conviction, must be fined not less than one hundred dollars nor more than two hundred dollars or imprisoned not less than thirty days nor more than sixty days, or both, in the discretion of the court. A person's license to sell alcoholic liquors must be revoked by the commission upon his conviction under this section.
(B) Failure of any a person to require identification to verify a person's age is prima facie evidence of the violation of this section."
SECTION 2. This act takes effect upon approval by the Governor.
