TO REQUIRE A RECIPIENT OF AID TO FAMILIES WITH DEPENDENT CHILDREN (AFDC) WHO IS A PARENT UNDER TWENTY-TWO YEARS OF AGE AND HAS NOT OBTAINED A STATE HIGH SCHOOL DIPLOMA OR ITS EQUIVALENT TO ENROLL IN A COURSE OF STUDY APPROVED BY THE STATE DEPARTMENT OF SOCIAL SERVICES WHICH WILL LEAD TO THE ACHIEVEMENT OF A HIGH SCHOOL DIPLOMA OR ITS EQUIVALENT, TO PROVIDE FOR WITHHOLDING AND THE FORFEITURE OF AFDC PAYMENTS UNDER CERTAIN CIRCUMSTANCES, TO PROVIDE FOR AFDC BONUSES UNDER CERTAIN CONDITIONS AND IN AMOUNTS AS PRESCRIBED BY THE STATE DEPARTMENT OF SOCIAL SERVICES, AND TO REQUIRE THE PROMULGATION OF REGULATIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. (A) A recipient of Aid to Families with Dependent Children (AFDC) who is a parent, is under twenty-two years of age, and has not obtained a state high school diploma or its equivalent shall enroll in a course of study approved by the State Department of Social Services, which will lead to the achievement of a high school diploma or its equivalent. If the recipient has more than two unexcused absences from such course in any one month, fifty dollars must be withheld from the recipient's monthly AFDC grant. If the recipient fails to enroll in a high school, or other, course as provided by this subsection, the AFDC recipient shall forfeit one-third of the AFDC grant. The prescribed amount for the unexcused absences must be withheld from the grant, cumulatively, for every month in which more than two unexcused absences occur. The AFDC recipient is entitled to a bonus for the successful completion of the course, in such amounts and under such conditions as prescribed by the State Department of Social Services.
(B) The State Department of Social Services shall promulgate regulations to carry out the provisions of this act, including, but not limited to, a uniform definition of "unexcused absence" and provisions for notifying the agency which disburses the AFDC grants.
SECTION 2. This act takes effect ninety days after approval by the Governor.
