A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-17-45 SO AS TO PROVIDE FOR THE REGULATION OF SEASONS AND FISHING ACTIVITIES IN SALTWATERS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 50-17-45. (A) Subject to Chapter 17 of Title 50 the department may establish open and closed seasons, areas, and fishing periods and prescribe limits and methods of taking fish in saltwaters of the State.

(B) Action taken under this section must comply with Section 50-17-90.

(C) A person violating this section is guilty of a misdemeanor and, upon conviction, must be punished as provided in Section 50-17-100. Upon conviction for a second or subsequent violation, the boat, motor, and fishing equipment of the violator must be confiscated and disposed of as provided in Section 50-17-650."

SECTION 2. This act takes effect upon approval by the Governor.
