TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 11-35-1595 SO AS TO REQUIRE CONTRACTS LET BY STATE AGENCIES FOR PROSTHETIC DEVICES OR OTHER SPECIALIZED EQUIPMENT MADE FOR THE PURPOSE OF IMPROVING THE QUALITY OF LIFE OF HANDICAPPED PERSONS TO ALLOW RESIDENTS OF THIS STATE NOT OTHERWISE ELIGIBLE TO RECEIVE BENEFITS UNDER THE CONTRACT TO PURCHASE SUCH ITEMS AT THE STATE PRICE, TO REQUIRE THE PURCHASER TO REIMBURSE THE AGENCY FOR THE COST OF THE ITEM PURCHASED, AND TO PROVIDE THAT THE AGENCY MAY RETAIN ONE HUNDRED PERCENT OF THE REIMBURSEMENT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Subarticle 3, Article 5, Chapter 35, Title 11 of the 1976 Code is amended by adding:
"Section 11-35-1595. Notwithstanding any other provision of law, any contract let by a state agency for prosthetic devices or other specialized equipment made for the purpose of improving the quality of life of handicapped persons must allow residents of this State not otherwise eligible for benefits under the contract to purchase these items at the state's contracted-for price. A private purchaser shall reimburse the agency for the cost of the item purchased in the manner that the agency may provide, including measures reasonably necessary to ensure payment. The agency may retain one hundred percent of these private reimbursements."
SECTION 2. This act takes effect July 1, 1993, and applies with respect to contracts let after June 30, 1993.
