A BILL

TO AMEND SECTION 59-29-80, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PHYSICAL EDUCATION REQUIREMENTS IN PUBLIC SCHOOLS, SO AS TO ALLOW VARSITY OR JUNIOR VARSITY SPORTS PARTICIPATION TO SUBSTITUTE FOR THE REQUIREMENT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 59-29-80 of the 1976 Code is amended to read:

"Section 59-29-80. (A) There shall must be established and provided in all the public schools of this State physical education, training and instruction of for pupils of both sexes,and every. Every pupil attending any such school, in so far as he is physically fit and able to do so, shall take course or the courses therein as provided required by this section. Suitable modified courses shall must be provided for students physically or mentally unable or unfit to take course or the courses prescribed for normal pupils.

(B) Provided, however, Notwithstanding subsection (A) of this section:that

(1) in any a public school which offers a an military or naval ROTC program sponsored by one of the a military services service of the United States, training in such a the program may be deemed considered equivalent to physical education instruction, and may be accepted in lieu of such the physical education instruction for all purposes, academic or nonacademic, as may hereinafter be provided.; (2) participation in a varsity or junior varsity sport may be substituted for the physical education requirement provided in this section."

SECTION 2. This act takes effect July 1, 1993.
