A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-77-370 SO AS TO PROVIDE THAT AN AUTOMOBILE INSURANCE CARRIER MAY NOT INCREASE THE AUTOMOBILE INSURANCE PREMIUM OF A PERSON WHO IS CONVICTED OF A TRAFFIC VIOLATION WHICH DOES NOT EXPOSE A MEMBER OF THE PUBLIC OTHER THAN HIMSELF TO A THREAT OF PROPERTY DAMAGE OR BODILY INJURY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 38-77-370. An automobile insurance carrier may not increase the automobile insurance premium of a person who is convicted of a traffic violation which does not expose a member of the public other than himself to a threat of property damage or bodily injury. The court in which the person is convicted shall determine if the violation imposed a threat of property damage or bodily injury."

SECTION 2. This act takes effect upon approval by the Governor.
