AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 41-35-115 SO AS TO PROVIDE THAT NO INDIVIDUAL OTHERWISE ELIGIBLE SHALL BE DENIED BENEFITS WITH RESPECT TO ANY WEEK IN WHICH HE IS REQUIRED BY LAW TO APPEAR IN COURT AS A WITNESS OR TO SERVE AS A JUROR, AND PROVIDE THAT BENEFITS MUST BE REDUCED BY ANY PER DIEM RECEIVED FOR SERVICE AS A JUROR.
Be it enacted by the General Assembly of the State of South Carolina:
Unemployment benefits
SECTION 1. The 1976 Code is amended by adding:
"Section 41-35-115. Notwithstanding any other provision of law no individual otherwise eligible for benefits shall be denied benefits with respect to any week in which he is required by law to appear in court as a witness or to serve as a juror. However, unemployment benefits received by a person pursuant to Chapters 27 through 41 of this title must be reduced by any per diem received for service as a juror. The commission shall promulgate regulations necessary to implement the provisions of this section."
Time effective
SECTION 2. This act takes effect January 1, 1993.
