AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-30-11 SO AS TO PROVIDE THAT BY SEPTEMBER 1, 1993, THE STATE DEPARTMENT OF EDUCATION SHALL DEVELOP AN ALTERNATIVE ASSESSMENT MECHANISM TO THE WRITTEN PORTION OF THE EXIT EXAM FOR THOSE STUDENTS WHO HAVE DOCUMENTED DISABILITIES, SUCH AS SEVERE TO PROFOUND HEARING DISABILITY OR ENGLISH AS A SECOND LANGUAGE, AND TO PROVIDE THAT UNTIL THIS ALTERNATIVE IS DEVELOPED, PASSING THE WRITTEN PORTION OF THE EXIT EXAM IS WAIVED FOR THE PURPOSES OF RECEIVING A STATE HIGH SCHOOL DIPLOMA FOR THOSE STUDENTS WHO HAVE PERFORMED ABOVE AVERAGE ON OTHER MEASURES OF ACHIEVEMENT AND WHO ARE OTHERWISE QUALIFIED TO RECEIVE THE DIPLOMA.

Be it enacted by the General Assembly of the State of South Carolina:

Alternate assessment mechanism to written portion of exit exam

SECTION 1. The 1976 Code is amended by adding:

"Section 59-30-11. Notwithstanding the provisions of Section 59-30-10(f), by September 1, 1993, the State Department of Education shall develop an alternative assessment mechanism to the written portion of the exit exam for those students who have documented disabilities, such as severe to profound hearing disability or English as a second language. Until this alternative is developed, passing the written portion of the exit exam is waived for the purposes of receiving a state high school diploma for those students who have performed above average on other measures of achievement and who are otherwise qualified to receive the diploma."

Time effective

SECTION 2. This act takes effect upon approval by the Governor.
