A BILL

TO PROVIDE THAT IN THE PUBLIC SCHOOLS PUPILS SHALL ATTEND PRIMARY SCHOOLS WHICH SHALL NOT BE BASED ON AGE, EXCEPT IN CERTAIN CIRCUMSTANCES, NOR MAINTAIN TRADITIONAL KINDERGARTEN THROUGH GRADE THREE BUT WHICH SHALL BE BASED ON PROGRESS MEASURED BY PERIODIC TESTING AND EVALUATION, AND REQUIRE THE STATE BOARD OF EDUCATION TO PROVIDE FOR THE IMPLEMENTATION OF THIS ACT BY NECESSARY REGULATIONS AND DIRECTIVES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Notwithstanding any other provision of law and for the purposes of Title 59 of the 1976 Code of Laws and subject to the provisions of Section 59-65-10(A), in the public schools of this State pupils entering kindergarten and up to the time they would normally and traditionally commence what traditionally has been and is known as grade four shall attend primary schools which shall not be based on age, except as specifically provided in Section 59-65-10(A), nor maintain traditional kindergarten through grade three but which shall be based on progress attained in the various subjects and courses measured by periodic testing and evaluation. The State Board of Education shall provide for the implementation of the provisions of this section by necessary regulations and directives.

SECTION 2. This act takes effect July 1, 1994.
