TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 23-9-395 SO AS TO REQUIRE PAID AND VOLUNTEER FIREFIGHTERS OF LAWFULLY AND REGULARLY ORGANIZED FIRE DEPARTMENTS TO UNDERGO STATE AND FEDERAL FINGERPRINT REVIEWS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 23-9-395. A paid and volunteer firefighter of a lawfully and regularly organized fire department shall undergo a state fingerprint review to be conducted by the State Law Enforcement Division to determine state criminal history and a federal fingerprint review to be conducted by the Federal Bureau of Investigation to determine other criminal history. The results of the reviews must be furnished to the State Fire Marshal before the firefighter begins his work with the department. If a fee is charged by the Federal Bureau of Investigation for the review, it must be paid by the firefighter."
SECTION 2. This act takes effect upon approval by the Governor and applies to paid and volunteer firefighters working on the effective date of this act and paid and volunteer firefighters beginning work after the effective date. However, the firefighters working on the effective date may continue to work while undergoing the reviews required by Section 23-3-395 of the 1976 Code added in Section 1.
