A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-15-125 SO AS TO PROHIBIT SODOMY, DEFINE THE OFFENSE, PROVIDE PENALTIES, AND TO ADD THE OFFENSE TO THE LIST OF FELONIES IN SECTION 16-1-10.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 16-15-125. (A) It is unlawful for a person to commit sodomy with another person. A person commits the offense of sodomy when he performs or submits to any sexual act involving the sex organs of one person and the mouth or anus of another. A person who commits sodomy is guilty of a felony, and upon conviction, must be imprisoned not more than five years.

(B) It is unlawful for a person to commit aggravated sodomy. A person commits the offense of aggravated sodomy when he commits sodomy with force and against the will of the other person. A person who commits aggravated sodomy is guilty of a felony and upon conviction must be imprisoned not more than ten years."

SECTION 2. The offenses established in Section 16-15-125 of the 1976 Code are added to the list of felonies in Section 16-1-10.

SECTION 3. This act takes effect upon approval by the Governor.
