A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 46-1-160 SO AS TO PROHIBIT THE SALE OF TOBACCO PRODUCTS ON CREDIT, DEFINE TERMS, AND PROVIDE AN EXCEPTION AND PENALTIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 46-1-160. (A) Tobacco products may be sold only by the use of cash or an approved debit or credit card.

(B) Tobacco products include, but are not limited to, cigarettes, cigars, smoking tobacco, chewing tobacco, and snuff. Cash includes money, checks, and money orders.

(C) A person violates this section if he issues a check or debit or credit card with insufficient funds available.

(D) This section applies to all sales of tobacco products, except sales from the producer or farmer of the tobacco to the manufacturer.

(E) A person who purchases or sells tobacco products in violation of this section, upon conviction, must be fined not more than two hundred dollars or imprisoned not more than thirty days."

SECTION 2. This act takes effect upon approval by the Governor.
