A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 20-7-285 SO AS TO PROHIBIT DISPENSING OF CONTRACEPTIVES TO MINORS WITHOUT PARENTAL NOTICE AND TO PROVIDE PENALTIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 20-7-285. Before providing contraceptives to a minor, a person shall notify, whenever possible, the minor's parents or legal guardian of the service requested to be provided to the minor. Contraceptives are defined as appliances, drugs, or medicinal preparations intended or having special utility for prevention of conception. A minor who provides written notice signed by a parent, legal guardian, or grandparent or obtains a judicial order allowing a person to provide contraceptives may receive them. The procedure to obtain judicial consent must be established by the family court and must be similar to the requirements established for a minor to obtain judicial consent for an abortion as provided in Sections 44-41-31 through 44-41-34.

A person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction, must be imprisoned not more than ninety days."

SECTION 2. This act takes effect upon approval by the Governor.
