A BILL

TO AMEND SECTION 50-13-210, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE DAILY CREEL LIMITS ON GAME FISH, SO AS TO DELETE THE REFERENCE TO THE AUTHORITY FOR DEPARTMENT REGULATIONS; TO AMEND SECTION 50-13-235, RELATING TO THE PROHIBITION AGAINST TAKING STRIPED BASS UNDER CERTAIN CONDITIONS, SO AS TO DELETE THE PROHIBITION, AUTHORIZE THE DEPARTMENT TO SET THE DAILY CREEL LIMITS AND SIZE LIMITS FOR STRIPED BASS AND BLACK BASS, AND PROVIDE RELATED REQUIREMENTS; TO AMEND SECTION 50-13-285, RELATING TO PENALTIES FOR EXCEEDING CREEL LIMITS, SO AS TO REVISE THE CONVICTIONS TO WHICH THE PENALTIES APPLY; AND TO REPEAL SECTIONS 50-13-220 AND 50-13-230 RELATING TO STRIPED BASS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 50-13-210 of the 1976 Code is amended to read:

"Section 50-13-210. It is unlawful for a person in any one day to catch more than forty game fish;. However, of the total creel limit not more than:

(1) not more than ten of the total may be striped bass (Rockfish) or hybrid bass (striped bass-white bass) or a combination of them unless regulations promulgated by the department and adopted by the General Assembly by authority of Section 50-13-236 reflect otherwise;

(2) not more than ten of the total may be black bass (large mouth, small mouth, coosae) or a combination of them unless regulations promulgated by the department and adopted by the General Assembly by authority of Section 50-13-236 reflect otherwise;

(3) not more than ten of the total may be trout;

(4) not more than eight of the total may be walleye or sauger or a combination of them;

(5) not more than thirty of the total may be any a game fish not specified."

SECTION 2. Section 50-13-235 of the 1976 Code is amended to read:

"Section 50-13-235. It is unlawful to take or possess striped bass (rockfish) less than eighteen inches in Lake Marion and Moultrie, the Congaree River, the Wateree River northward to the Lake Wateree Dam, the Saluda River northward to the Lake Murray Dam and the Santee River southward to the saltwater-freshwater dividing line. (A) The department may set the daily creel limits and size limits for striped bass and black bass in the freshwaters of the State. Before the establishment of these limits the agency shall conduct a minimum of two public hearings under the direction of an impartial hearing officer. One hearing must be in the immediate area affected by the proposed action, and one must be held in Columbia. The hearing officer shall report his findings to the commission and upon unanimous approval by those commissioners present, the proposal must be accepted. All size and creel limits implemented by this section remain in force for a maximum of four years with renewal requiring public hearings and unanimous commission approval.

(B) The department shall publish these limits by July first each year. A violation of these limits is punishable as provided in Section 50-13-285."

SECTION 3. Section 50-13-285 of the 1976 Code is amended to read:

"Section 50-13-285. Any A person violating the provisions of Sections 50-13-210, 50-13-220 50-13-235, 50-13-250, or 50-13-280, must upon conviction for a first offense of any of the sections, must be fined not less than thirty dollars nor more than two hundred dollars or imprisoned for not more than thirty days and, for a subsequent offense, of any of the sections be fined not less than three hundred dollars nor more than five hundred dollars or imprisoned for not more than sixty days, or both. A subsequent offense is an offense against any of the sections and not any one in particular. But only those offenses of any of the sections An offense which occurred within a period of two years, including and immediately preceding the date of the last offense shall constitute, constitutes a prior offenses offense within the meaning of this section."

SECTION 4. Sections 50-13-220 and 50-13-230 of the 1976 Code are repealed.

SECTION 5. This act takes effect upon approval by the Governor.
