THE COMMITTEE ON EDUCATION AND PUBLIC WORKS

To whom was referred a Bill (H. 3996), to amend Section 56-3-375, Code of Laws of South Carolina, 1976, relating to the registration of motor vehicles, etc., respectfully

REPORT:

That they have duly and carefully considered the same, and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by striking all after the enacting words and inserting:

/SECTION 1. The 1976 Code is amended by adding:

"Section 56-3-370. A person is not required to maintain registration and licensing for a vehicle that is not operated, is in storage, or is inoperable. A person subsequently may register and license this vehicle upon payment of the license fee required by this chapter upon proof the motor vehicle is insured and if the previous registration and licensing of the vehicle has not violated Sections 56-10-240 and 56-10-245."

SECTION 2. This act takes effect upon approval by the Governor./

STATEMENT OF ESTIMATED FISCAL IMPACT

This Bill adds Section 56-3-370, relating to the registration of motor vehicles so as to provide for reregistration of a vehicle that was inoperable or in storage.

This Bill would have no effect on state or local revenue.

Section 56-3-375, imposing a five dollar penalty fee, was repealed by Act Number 165 of 1993. Therefore, no penalty revenue will be foregone because of this legislation.

A BILL

TO AMEND SECTION 56-3-375, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE REGISTRATION OF MOTOR VEHICLES SO AS TO PROVIDE FOR REREGISTRATION OF A VEHICLE THAT WAS INOPERABLE OR IN STORAGE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The last paragraph of Section 56-3-375, as added by Act 278 of 1992, is amended to read:

"This section does not require a person to maintain registration and licensing for a vehicle that ceases to be operated, is in storage, or is inoperable. A person may subsequently may register and license a vehicle that is in storage, is not being operated, or is inoperable upon payment of a five-dollar penalty fee. However, the vehicle may be reregistered at the five-dollar fee only upon proof that the motor vehicle is insured and if the previous registration and licensing of the vehicle has not violated Sections 56-10-240 and 56-10-245."

SECTION 2. This act takes effect upon approval by the Governor.
