TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 1-3-245 SO AS TO PROVIDE THAT A MEMBER OF A STATE BOARD, COUNCIL, OR COMMISSION WHO HAS THREE CONSECUTIVE UNEXCUSED ABSENCES FROM MEETINGS IS CONSIDERED REMOVED FROM OFFICE AND A VACANCY IS CREATED AND TO PROVIDE THAT THIS SECTION DOES NOT APPLY TO EX OFFICIO MEMBERS OR THEIR DESIGNEES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The l976 Code is amended by adding:
"Section l-3-245. (A) A member of a state board, council, or commission who has three consecutive unexcused absences from meetings held by the particular board, council, or commission is considered removed from the board, council, or commission and a vacancy is created. An unexcused absence must be defined by each respective board, council, or commission in rules governing its own operation.
(B) This section does not apply to ex officio members of state boards, committees, councils, or commissions or to designees of ex officio members."
SECTION 2. This act takes effect upon approval by the Governor.
