A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 5-7-85 SO AS TO PROHIBIT AN ORDINANCE OF A MUNICIPALITY OR THE EXERCISE OF ITS POLICE POWERS FROM PROHIBITING THE ASSEMBLY OF PEOPLE PROVIDED THERE IS NO BREACH OF THE PEACE OR SIDEWALKS OR STREETS BEING BLOCKED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 5-7-85. No ordinance of a municipality or exercise of its police powers may prohibit the assembly of people for any reason so long as the assembly does not constitute a breach of the peace and does not block a sidewalk, street, or public thoroughfare."

SECTION 2. This act takes effect upon approval by the Governor.
