AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 57-3-625 SO AS TO PROVIDE THAT IF ACCESS TO A PARTICULAR PROPERTY OR PROPERTIES IS CONTROLLED BY A TRAFFIC SIGNAL, THE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION MAY REQUIRE THAT IMPROVEMENTS BE MADE TO THE PROPERTY WITHIN FIVE HUNDRED FEET OF THE DEPARTMENT'S RIGHT OF WAY WHICH ARE NECESSARY TO IMPROVE TRAFFIC FLOW AT THE INTERSECTION CONTROLLED BY THE TRAFFIC SIGNAL, AND TO SPECIFY THE TYPE OF IMPROVEMENTS REQUIRED.
Be it enacted by the General Assembly of the State of South Carolina:
Improvements to property to improve traffic flow
SECTION 1. The 1976 Code is amended by adding:
"Section 57-3-625. If access to a particular property or properties is controlled by a traffic signal, the Department of Highways and Public Transportation may require that improvements be made to the property within five hundred feet of the department's right of way which are necessary to improve traffic flow at the intersection controlled by the traffic signal. The required improvements must be limited to lane widening, adding a lane, curb cuts, medians, and similar improvements. Under this section, demolition or alteration of a permanent building on the property must not be required by the department. The property owner is not required to pay for improvements performed by the department."
Time effective
SECTION 2. This act takes effect upon approval by the Governor.
