To whom was referred a Concurrent Resolution (H. 4266), to request that prior to submitting a settlement proposal to the attorneys representing the plaintiffs or to the court hearing the case styled Alexander S. et al. vs. Richard E. McLawhorn et al., etc., respectfully
That they have duly and carefully considered the same, and recommend that the same do pass:

TO REQUEST THAT PRIOR TO SUBMITTING A SETTLEMENT PROPOSAL TO THE ATTORNEYS REPRESENTING THE PLAINTIFFS OR TO THE COURT HEARING THE CASE STYLED ALEXANDER S. ET AL. VS. RICHARD E. MCLAWHORN ET AL., THE ATTORNEYS REPRESENTING THE DEPARTMENT OF YOUTH SERVICES SUBMIT AND RECEIVE APPROVAL OF ITS TERMS FROM THE WAYS AND MEANS COMMITTEE, THE FINANCE COMMITTEE, AND THE GOVERNOR.
Whereas, the Department of Youth Services is involved in litigation styled ALEXANDER S. ET AL. VS. RICHARD E. MCLAWHORN ET AL.; and
Whereas, the attorneys for the Department of Youth Services have expressed a desire to enter into settlement negotiations with the attorneys for the plaintiffs in this case; and
Whereas, the terms of any such settlement may require the appropriations of additional funding for the budget of the department; and
Whereas, the Ways and Means Committee, the Finance Committee, and the Governor desire to approve the distribution of any funds, if such settlement is beyond that which would be applicable, is necessary to avoid an adverse result. Now, therefore,
Be it resolved by the House of Representatives, the Senate concurring:
That prior to submitting a settlement proposal to the attorneys representing the plaintiffs or to the court hearing the case styled Alexander S. et al. vs. Richard E. Mclawhorn et al., the attorneys representing the Department of Youth Services are requested to submit and receive approval of its terms from the Ways and Means Committee, the Finance Committee, and the Governor.
Be it further resolved that a copy of this resolution be forwarded to the attorneys representing the Department of Youth Services, and Interim Commissioner Michael Grant LeFever.
