A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-73-765 SO AS TO ELIMINATE A SURCHARGE FOR AN INSURED IN CERTAIN INSTANCES FOR PURPOSES OF A MERIT RATING PLAN OR SYSTEM UNDER THE AUTOMOBILE INSURANCE LAWS OF THIS STATE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 38-73-765. Notwithstanding any other provision of law, an insured must not be assessed, for purposes of a merit rating plan or system under Section 38-73-760 or any other provision of law, a surcharge (including loss of the safe driver discount) for:

(1) his first violation under Section 56-1-720 involving four points or less than four points occurring in a three-year period; or

(2) his first motor vehicle accident involving property damage totaling more than seven hundred fifty dollars occurring in a three-year period."

SECTION 2. This act takes effect upon approval by the Governor.
