TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 40-59-76 SO AS TO FURTHER PROVIDE FOR THE MANNER IN WHICH THE COST OF THE UNDERTAKING IS DETERMINED FOR RESIDENTIAL BUILDER AND RESIDENTIAL SPECIALTY CONTRACTOR PURPOSES; AND TO AMEND SECTION 40-59-77, AS AMENDED, RELATING TO CLASSIFICATION AND REGISTRATION OF RESIDENTIAL SPECIALTY CONTRACTORS, SO AS TO PROVIDE THAT THE RESIDENTIAL BUILDERS COMMISSION SHALL INSURE THAT RESIDENTIAL SPECIALTY CONTRACTORS POSSESS QUALIFICATIONS AND EXPERIENCE IN THEIR PARTICULAR CONTRACTING VOCATION, INCLUDING THE AUTHORITY OF THE COMMISSION TO DETERMINE THESE QUALIFICATIONS BY USE OF AN EXAMINATION WHERE NECESSARY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 40-59-76. In determining whether or not the cost of the undertaking exceeds five thousand dollars for purposes of Sections 40-59-10 and 40-59-75(B), the cost of all work performed or to be performed on the property by the same person within a period of ninety days must be considered whether performed as a single project or as multiple projects."
SECTION 2. Section 40-59-77(B) of the 1976 Code, as last amended by Act 72 of 1993, is further amended to read:
"(B) Residential specialty contractors must be qualified and experienced in the particular branches or fields of the contracting vocation in which they intend to, and do, engage. Before a residential specialty contractor may be registered by the commission, it shall insure that the residential specialty contractor has these qualifications and experience and may do so by considering the past experience of the specialty contractor or where the past experience history is insufficient, by use of an examination. The fee must be set by the commission by regulation.
Residential specialty contractors are not exempt from complying with county and municipal business license ordinances or other regulatory ordinances. Any county or municipality may require a residential specialty contractor to be examined and licensed in accordance with standards adopted by the county or municipality."
SECTION 3. This act takes effect upon approval by the Governor.
