A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 23-35-15 SO AS TO PROVIDE THAT A COUNTY OR MUNICIPALITY MAY ENACT LOCAL ORDINANCES REGULATING THE STORAGE, SALE, AND USE OF FIREWORKS WITHIN ITS JURISDICTION WHICH ARE NOT IN CONFLICT WITH THE PROVISIONS OF STATE LAW OR THE REGULATIONS PROMULGATED UNDER IT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 23-35-15. A county or municipality may enact local ordinances regulating the storage, sale, and use of fireworks within its jurisdiction which are not in conflict with the provisions of this chapter or the regulations promulgated under it. These local ordinances may include penalties for violation."

SECTION 2. This act takes effect upon approval by the Governor.
