A BILL

TO AMEND SECTION 47-3-710, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE DEFINITION OF DANGEROUS ANIMALS, SO AS TO EXEMPT ANIMALS USED BY LOCAL OR STATE LAW ENFORCEMENT PERSONNEL FOR LAW ENFORCEMENT PURPOSES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 47-3-710(B) of the 1976 Code, as last amended by Act 374 of 1992, is further amended to read:

"(B) `Dangerous animal' does not include an animal:

(1) an animal used exclusively for agricultural purposes; or

(2) an animal which attacks a person who is trespassing or who appears to be trespassing. A trespasser is a person who is not lawfully upon the premises of the owner, as set forth in Section 47-3-770(A); or

(3) used by local or state law enforcement personnel for law enforcement purposes."

SECTION 2. This act takes effect upon approval by the Governor.
