A BILL

TO AMEND SECTION 50-11-2440, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE VISITATION AND SETTING OF TRAPS, SO AS TO AUTHORIZE THE REMOVAL AT NIGHT OF ANIMALS CAUGHT IN RUBBER-PADDED LEGHOLD TRAPS IN GAME ZONE 9.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 50-11-2440 of the 1976 Code, as last amended by Section 1262, Act 181 of 1993, is further amended to read:

"Section 50-11-2440. (A) A trapper shall visit his traps daily and remove any animal caught but. However, no trapper may visit any a trap at night, except as provided in subsection (B), and no trap may be set `in the open' or in paths, roadways, or runways commonly used by persons or domestic animals.

(B) In Game Zone 9, it is lawful to remove at night any animal caught in a rubber-padded leghold trap."

SECTION 2. This act takes effect upon approval by the Governor.
