A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 61-13-285 SO AS TO PROHIBIT THE SALE OF BEER BONGS, FUNNELS, OR SIMILAR PARAPHERNALIA AND TO PROVIDE PENALTIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 61-13-285. It is unlawful for a person to sell beer bongs, funnels, or other instrument, device, article, or contrivance used, designed for use, or intended for use in ingesting beer, wine, alcoholic beverages, or intoxicating liquors in large or excessive quantities without intaking air in a short period of time.

A person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction, must be imprisoned not more than thirty days or fined not more than five hundred dollars, or both. In addition to the criminal penalty any license issued to the person under this title may be revoked."

SECTION 2. This act takes effect upon approval by the Governor.
