A JOINT RESOLUTION

TO REQUIRE THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL TO IMMEDIATELY ENFORCE ITS ADMINISTRATIVE ORDER REQUIRING THE CAROLINA WATER SERVICE OF CHARLESTON COUNTY TO CONNECT ITS PEPPERHILL SEWAGE SYSTEM INTO THE NORTH CHARLESTON SEWER DISTRICT.

Whereas, Carolina Water Service (CWS) owns and operates the sewage system and treatment pond in the Pepperhill subdivision in Charleston County and although the Department of Health and Environmental Control (DHEC) records reveal that the permit for discharge expired in February of 1990, CWS continues to discharge treated sewage into the Ashley River; and

Whereas, when DHEC denied Carolina Water Service's permit renewal, the department directed CWS to connect the Pepperhill system into the North Charleston Sewer District for discharge into the Cooper River; and

Whereas, in September 1991, DHEC issued an administrative order again requiring Carolina Water Service to connect to the North Charleston Sewer District and Carolina Water Service filed an appeal to this order; and

Whereas, to date DHEC has not enforced its September 1991 administrative order and Carolina Water Service continues its discharge into the Ashley River. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The Department of Health and Environmental Control immediately shall enforce its September 1991 administrative order requiring Carolina Water Service of Charleston County to connect its Pepperhill sewage system to the North Charleston Sewer District.

SECTION 2. This joint resolution takes effect upon approval by the Governor.
