TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 2-1-105 SO AS TO PROVIDE THAT AFTER JULY 1, 1994, NO PERSON WHO IS A MEMBER OF THE IMMEDIATE FAMILY OF A SITTING MEMBER OF THE GENERAL ASSEMBLY MAY BE ELECTED OR APPOINTED TO ANY OFFICE WHICH IS FILLED BY ELECTION OR APPOINTMENT OF THE GENERAL ASSEMBLY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 2-1-105. After July 1, 1994, no person who is a member of the immediate family of a sitting member of the General Assembly may be elected or appointed to any office which is filled by election or appointment of the General Assembly. For purposes of this section, the term `immediate family' is as defined in Section 2-17-10(7).
Any member of the immediate family of a sitting member of the General Assembly serving in office in violation of the provisions of this section may complete the term for which he was elected or appointed and thereafter may not be re-elected or reappointed to the office so long as the immediate family member continues to serve in the General Assembly."
SECTION 2. This act takes effect upon approval by the Governor.
