AN ACT TO PROVIDE THAT THE CALHOUN COUNTY SCHOOL DISTRICT SHALL BE GOVERNED AND MANAGED BY A BOARD OF TRUSTEES, THE NUMBER OF WHICH MUST BE THE SAME AS THE NUMBER OF MEMBERS COMPRISING THE CALHOUN COUNTY COUNCIL, PROVIDE FOR THE ELECTION OF THE SCHOOL TRUSTEES FROM SINGLE-MEMBER ELECTION DISTRICTS, PROVIDE FOR THE QUALIFICATIONS AND TERMS OF THE TRUSTEES AND FOR THE REAPPORTIONMENT OF THE TRUSTEES' ELECTION DISTRICTS, PROVIDE FOR THE FILLING OF VACANCIES, AND PROVIDE FOR THE ELECTION OF TRUSTEES ON A NONPARTISAN BASIS AND FOR THE ANNUAL ELECTION OF THE SCHOOL BOARD'S CHAIRMAN; TO PROVIDE THAT MEMBERS OF THE BOARD OF TRUSTEES OF THE CALHOUN COUNTY SCHOOL DISTRICT ELECTED IN 1992 SHALL CONTINUE IN OFFICE UNTIL THE PRESCRIBED EXPIRATION OF THEIR TERMS AND THAT ALL MEMBERS OF THE BOARD WHOSE TERMS WOULD OTHERWISE COMMENCE FOLLOWING THE 1994 ELECTION MUST BE ELECTED IN 1994 ACCORDING TO THE PROVISIONS OF THIS ACT; TO PROVIDE THAT THE INCUMBENT CHAIRMAN OF THE BOARD SHALL CONTINUE AS A MEMBER AND AS CHAIRMAN OF THE BOARD FOR THE REMAINDER OF HIS TERM AS A BOARD MEMBER; AND TO REPEAL SECTION 2 OF ACT 743 OF 1976, RELATING TO THE BOARD OF TRUSTEES OF THE CALHOUN COUNTY SCHOOL DISTRICT.

Be it enacted by the General Assembly of the State of South Carolina:

Board of Trustees, election; etc.

SECTION 1. Notwithstanding any other provision of law, the Calhoun County School District shall be governed and managed by a board of trustees, the number of which must be the same as the number of members comprising the Calhoun County Council, except as hereinafter specifically provided. The members of the Board of Trustees of the Calhoun County School District must be elected from the same single-member election districts provided by law for the election of members of the Calhoun County Council, as approved by the United States Department of Justice in 1992.

Each member of the Board of Trustees of the Calhoun County School District must be a qualified elector of the single-member election district he represents and, except in the case of filling a vacancy as hereinafter prescribed, must be elected by the qualified electors of that election district only.

The terms of office for the members of the board are the same as those prescribed by law for the members of the county council, and each member of the board shall serve co-terminously with the respective member of the county council elected from his single-member election district. The single-member election districts for the board must be re-apportioned simultaneously with the county council election districts.

Vacancies occurring on the board must be filled by a majority of the remaining members of the board for the unexpired portion of the term only.

Members of the board must be elected on a nonpartisan basis at the same time that members of the county council are elected.

The board's chairman must be elected annually by the members of the board.

Continuation in office, etc.

SECTION 2. Members of the Board of Trustees of the Calhoun County School District elected in 1992 shall continue in office until the expiration of their terms in accordance with the provisions of Section 1 of this act. All members of the board whose terms would otherwise commence following the 1994 election, in accordance with the provisions of Section 1, must be elected in 1994 according to the provisions of that section.

Board chairman, incumbent, and successor

SECTION 3. Notwithstanding the provisions of Section 1 of this act, the incumbent chairman of the Board of Trustees of the Calhoun County School District, serving in that office on the effective date of this act, shall continue as a member and as the chairman of the board for the remainder of that term of office as a board member. Thereafter, the chairman of the board must be elected in accordance with the provisions of Section 1.

Provisions repealed

SECTION 4. Section 2 of Act 743 of 1976 is repealed.

Time effective

SECTION 5. This act takes effect upon approval by the Governor.
