A BILL

TO AMEND SECTION 5-31-210, CODE OF LAWS OF SOUTH CAROLINA, 1976, AS AMENDED, RELATING TO THE ELECTION AND TERMS OF COMMISSIONERS OF PUBLIC WORKS IN MUNICIPALITIES, SO AS TO REQUIRE REPRESENTATION ON THE COMMISSION BASED ON ITS SERVICE TO THE UNINCORPORATED AREA IT SERVES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 5-31-210 of the 1976 Code, as last amended by Act 117 of 1989, is further amended by adding at the end:

"Notwithstanding the provisions of this section, the unincorporated area served by the commission of public works must be represented on the commission based on the percent of the service to the unincorporated area. All members of the governing body must be elected in the same manner."

SECTION 2. This act takes effect January 1, 1995, except selection of members of the governing body of water and sewer systems pursuant to the amendment to Section 5-31-210 of the 1976 Code in this act may occur before that date.
