A BILL

TO PROVIDE A PROCEDURE BY WHICH A BINDING REFERENDUM MAY BE INITIATED TO DETERMINE IF THE AUTHORITY OF THE BOARD OF TRUSTEES OF THE SCHOOL DISTRICT OF CHESTER TO ADOPT AN ANNUAL BUDGET AND SET TAX LEVIES FOR THE OPERATION OF THE SCHOOL DISTRICT IS DEVOLVED ON THE GOVERNING BODY OF CHESTER COUNTY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. (A) A referendum must be conducted to determine whether the board of trustees of the school district of Chester County may continue to determine the annual budget and set tax levies for the operation of the district or to devolve that responsibility on the governing body of Chester County upon receipt of:

(1) a petition requesting the devolution signed by fifteen percent of the qualified electors of the School District of Chester County, certified by the Chester County Election Commission, or

(2) a resolution requesting the devolution be adopted by the governing body of Chester County.

(B) Petitions must be certified to the governing body of Chester County by the county board of voter registration within sixty days after they have been delivered to the board.

(C) The governing body of Chester County must call for a referendum to be conducted at the time of the next general election if it receives a certified petition or adopts a resolution requesting devolution of the powers provided for in (A).

(D) The referendum must be conducted by the county election commission according to the election laws of this State, mutatis mutandis.

(E) If a majority of the qualified electors voting in the referendum approve the devolution of power described in (A), beginning one week after the results of the referendum are certified by the county election commission, the powers of the Board of Trustees of the School District of Chester County relating to the authority to determine the annual budget and set tax levies for the operation of the district are devolved on the governing body of Chester County.

(F) After a referendum has been held pursuant to the provisions of this act, whether or not a change results from it, no additional referendums may be held for a period of three years.

(G) A referendum to devolve the powers, described in (A), from the governing body of the county to the Board of Trustees of the School District of Chester County may be accomplished by following the provisions of this act.

SECTION 2. This act takes effect upon approval by the Governor.
