TO AMEND SECTION 50-17-310, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PERMITS FOR USE OF INTERTIDAL OR SUBTIDAL BOTTOMS FOR SHELLFISH CULTURE OR MARICULTURE, SO AS TO PROVIDE THAT THE DEPARTMENT MAY INCREASE TO A MAXIMUM OF ONE THOUSAND ACRES THE ACREAGE FOR SHELLFISH MARICULTURE OF AN APPLICANT WHO IS FULLY UTILIZING THE AREAS CURRENTLY PERMITTED, HAS MET PERMIT CONDITIONS, AND HAS DEMONSTRATED A NEED FOR SHELLFISH GROWING AREAS IN EXCESS OF FIVE HUNDRED ACRES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 50-17-310 of the 1976 Code is amended to read:
"Section 50-17-310. (A) The department may grant permits to any state resident for the exclusive use of portions of the intertidal or subtidal bottoms owned or controlled by the State for shellfish culture or mariculture for commercial purposes, not exceeding an aggregate of five hundred acres to any firm or individual. For any shellfish culture purpose other than for commercial use, the department may issue permits for as many as two acres, but no more, to any state resident at the annual fee provided in Section 50-17-335.
(B) Notwithstanding the restrictions outlined in subsection (A) above, if the department determines that an applicant, for shellfish mariculture acreage, is fully utilizing areas currently permitted, has met permit conditions, and has demonstrated a need for shellfish growing areas in excess of five hundred acres, the department may issue permits to such applicant for areas exceeding five hundred acres but not exceeding one thousand acres.
(B) (C) Each permit issued under this section must be for five years and may be renewed at the option of the department for an additional five years at the yearly rate provided in Section 50-17-335."
SECTION 2. This act takes effect upon approval by the Governor.
