A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 20-7-781 SO AS TO PROVIDE THAT CERTAIN INFORMATION CONTAINED IN OFFICIAL JUVENILE RECORDS MAY BE RELEASED TO SCHOOL OFFICIALS, AND TO PROVIDE PROCEDURES FOR REQUESTS.

Whereas, the General Assembly finds that there has been an increase in criminal activity and violence in the public schools of this State; and

Whereas, public school officials need information about students to manage problems associated with criminal activity to protect all persons on school property. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 20-7-781. Notwithstanding other provisions of law relating to the confidentiality of juvenile records, a law enforcement agency must release information about the criminal activity of a juvenile to the superintendent of the school district in which the juvenile is enrolled or in which the juvenile is seeking to be enrolled. Information must include not only adjudicated offenses, but offenses that are pending or under investigation. A request for information must be in writing from the superintendent of the school district and must contain the juvenile's name, address, and social security number as contained in the records of the school district.

School officials must submit a request for information about a student to the superintendent of the district stating that the student's presence at school poses or tends to pose a significant threat to the physical safety and well-being of other persons at school. If necessary, the superintendent may require specific information about a school official's request.

All requests for information to the superintendent and to the law enforcement agency must be kept separate from records maintained on students."

SECTION 2. This act takes effect upon approval by the Governor.
