TO AMEND SECTION 56-5-1860, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PASSING LIMITATIONS FOR MOTOR VEHICLES SO AS TO PROVIDE THAT COMMERCIAL MOTOR VEHICLES MUST BE DRIVEN IN THE RIGHT LANE AT ALL TIMES EXCEPT WHEN PASSING ANOTHER VEHICLE AS AUTHORIZED BY THIS ARTICLE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 56-5-1860 of the 1976 Code is amended to read:
"Section 56-5-1860. (A) No vehicle shall be driven to the left side of the center of the roadway in overtaking and passing another vehicle proceeding in the same direction unless the left side is clearly visible and is free of oncoming traffic for a sufficient distance ahead to permit such overtaking and passing to be completely made without interfering with the operation of any vehicle approaching from the opposite direction or any vehicle overtaken. In every event the overtaking vehicle must return to an authorized lane of travel as soon as practicable and in the event the passing movement involves the use of a lane authorized for vehicles approaching from the opposite direction, before coming within two hundred feet of any approaching vehicle.
(B) Commercial motor vehicles passing another vehicle on any roadway having a passing lane or having four or more lanes shall be driven in the right lane at all times, except when overtaking and passing another vehicle as authorized by this article. The department shall erect such signs as appropriate to give notice to individuals operating commercial motor vehicles in this State of the provisions of this subsection."
SECTION 2. This act takes effect upon approval by the Governor.
