A BILL

TO AMEND CHAPTER 10 OF TITLE 56, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO MOTOR VEHICLE REGISTRATION, BY ADDING ARTICLE 5 SO AS TO PROVIDE FOR THE REGISTRATION OF OFF-ROAD MOTORCYCLES AND ALL TERRAIN VEHICLES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Chapter 10, Title 56 of the 1976 Code is amended by adding:

"Article 5

Section 56-10-310. Every owner of an all terrain vehicle (ATV) or off-road motorcycle shall make application to the Department of Motor Vehicles for a certificate of registration and a permanent license tag for the vehicle accompanied by the required fee and upon the appropriate form prescribed and furnished by the department.

Section 56-10-320. The certificate of registration must be in the possession of one transporting the vehicle on South Carolina highways or operating the vehicle on public land or land of one other than the registered owner.

Section 56-10-330. Any law enforcement official may stop and inspect an ATV or off-road motorcycle and require the operator or person transporting the vehicle to produce the certificate of registration which shall be made available to any law enforcement official upon request. If the Vehicle Identification Number (VIN) is missing or altered or such person unlawfully refuses to present the certificate as required by this article, the department through its designated agents or by request to a county or municipal law enforcement agency may take possession of the vehicle until the certificate is presented.

Section 56-10-340. Whenever any person other than a duly licensed ATV dealer receives by purchase, gift, trade, or otherwise a vehicle which was registered in this State, the person so receiving such vehicle shall within thirty days after the transfer of ownership make application to the department accompanied by the required fee for registration for such vehicle. The department upon being satisfied as to the genuineness and regularity of the application shall issue a new certificate of registration.

Section 56-10-350. For every ATV or off-road motorcycle, the registration fee shall be five dollars."

SECTION 2. This act takes effect upon approval by the Governor.
