A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 15-3-605 SO AS TO PROHIBIT A CIVIL ACTION FOR DAMAGES OR WRONGFUL DEATH ARISING OUT OF ILLEGAL ACTIONS BY THE MOVING PARTY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 15-3-605. No person may bring a civil action against another for damages for injuries or wrongful death sustained as a result of breaking and entering, robbery, burglary, a criminal offense involving the theft or destruction of real or personal property of another, or an attempt of these offenses. This section applies in actions brought by the plaintiff against the property owner or person acting on behalf of the property owner who, while defending the real or personal property or the life of another, inflicts injury or bodily harm upon the plaintiff or the plaintiff's decedent."

SECTION 2. This act takes effect upon approval by the Governor.
