The Senate assembled at 12:00 Noon, the hour to which it stood adjourned and was called to order by the PRESIDENT.

A quorum being present the proceedings were opened with a devotion by the Chaplain as follows:

Committee to Escort

The PRESIDENT appointed Senators RICHTER, CORK, WASHINGTON and MATTHEWS to escort Miss Frances Louise Parker, who was chosen Miss USA for 1994, and her party to the rostrum of the House of Representatives for the Joint Assembly.

At 12:15 P.M., the Senate appeared in the Hall of the House.

The PRESIDENT of the Senate called the Joint Assembly to order and announced that it had convened under the terms of a Concurrent Resolution adopted by both Houses.

Miss Frances Louise Parker and members of her party were escorted to the rostrum by Senators RICHTER, CORK, WASHINGTON and MATTHEWS and Representatives McTeer, White, A. Young and Harrell.

The PRESIDENT of the Senate, after brief remarks, introduced Miss Frances Louise Parker, who was chosen Miss USA 1994.

Miss Parker addressed the Joint Assembly.

Election

Immediately following the Joint Assembly honoring Miss Parker, Miss USA 1994, the PRESIDENT announced that the Joint Assembly would proceed to an election of successors to the Public Service Commission under the terms of a Concurrent Resolution adopted by both Houses.

Election to the Public Service Commission

First District

The PRESIDENT announced that nominations were in order to elect a successor to the Public Service Commission from the First District.

Senator HOLLAND, Chairman of the Committee to Review Candidates for the S.C. Public Service Commission, stated that Ms. Anne M. Bowen, Ms. Mignon Letitia Clyburn, Mr. Eugene Novgorodoff, Mr. William Saunders, Mr. Charles E. Schuster, Mr. Hubert Tyler, Mr. Flemister Lamarr Wiley and Mr. Richard Ganaway for the Public Service Commission from District 1 had been screened and found qualified.

Senator HOLLAND stated that Mr. Furman M. Reynolds, III had been screened and was found to be not qualified.

On motion of Senator HOLLAND, the names of Ms. Mignon Letitia Clyburn and Mr. Charles E. Schuster were withdrawn from consideration.

Senator HOLLAND nominated Ms. Anne M. Bowen, Mr. Richard Ganaway, Mr. Eugene Novgorodoff, Mr. William Saunders, Mr. Hubert Tyler and Mr. Flemister Lamarr Wiley for the Public Service Commission from District 1.

Election to the Public Service Commission

Second District

The PRESIDENT announced that nominations were in order to elect a successor to the Public Service Commission from the Second District.

Senator HOLLAND, Chairman of the Committee to Review Candidates for the S.C. Public Service Commission, stated that Mr. Robert Buford Dibble, Sr., Mr. Carl F. McIntosh, Mr. C. Robert Moseley, Ms. Margaret B. Reese and Mr. Charles Dukes Scott had been screened and found qualified.

Rep. Wright addressed remarks to the Joint Assembly.

Rep. Wright moved to adjourn debate on the election to the Public Service Commission, District 2, for two weeks.

Senator HOLLAND spoke on the motion.

Point of Order

Senator WILLIAMS raised a Point of Order that the motion would require unanimous consent inasmuch as the election had been established by Concurrent Resolution and it would require the adoption of a subsequent Concurrent Resolution in order to change the date of election.

The PRESIDENT sustained the Point of Order.

Senator WILLIAMS objected to the motion.

Rep. Wright moved to adjourn debate on the election to the Public Service Commission, District 2, until the conclusion of the remaining PSC District elections.

Point of Order

Rep. White raised a Point of Order that the motion was out of order as the order of elections was designated in the Concurrent Resolution which was adopted by both Houses.

The PRESIDENT stated that the motion was in order and overruled the Point of Order.

Rep. Baxley moved to table the motion to adjourn debate.

JOINT LEGISLATIVE COMMITTEE TO

STUDY CRIMINAL LAWS

March 15, 1994

Dear Legislative Members:

The Joint Legislative Committee to Study Criminal Laws was created by Act 184 of 1993. As required by the act, the following is the initial report of the committee.

The sixteen-member committee met and organized on November 18, 1993, and elected Senator Donald H. Holland as Chairman and Representative L. Morgan Martin as Vice Chairman.

The General Assembly has charged the committee with making "a continuous study and investigation of all facets of the laws relating to crime and punishment including, but not limited to, the study of revisions to this state's criminal code and the review of problems and concerns with the criminal justice system, so as to recommend appropriate statutory or regulatory modifications."

The committee has met and discussed general problems and concerns relating to all aspects of the criminal justice system in this State. The committee has heard testimony from various persons relating to prosecution of offenders, sentencing guidelines, classification act amendments, and juvenile crime. The committee intends to hear from other groups involved in the criminal justice system in the future.

This report contains the initial findings and recommendations of the committee.

INITIAL FINDINGS:

The committee finds that crime in South Carolina is a complex problem and is a major concern of the citizens of this State. It is the goal and purpose of this committee to carefully study all legislation which involves and impacts criminal laws.

The committee finds that while particular attention should be given to the impact of juvenile offenders and violent offenders on our State and criminal justice system, efforts must be concentrated on all areas of criminal law, including domestic violence, prison overcrowding, and sentencing laws.

The committee finds that crime has a major impact on all aspects of our society today. It impacts our state's economy, civil court system, family lives, and society as a whole.

The committee finds that it must study the criminal rather than just the crimes committed.

INITIAL RECOMMENDATIONS:

The committee recommends that the "clean-up" legislation to the Crime Classification Act of 1993 be enacted. At the time of this report, several House bills, including H. 4323, H. 4350, H. 4356, H. 4358, H. 4359, H. 4365, and H. 4512, are pending which would accomplish this. Also, there is a Senate Judiciary Committee Bill, S. 1157, pending which encompasses all of the suggested revisions in one bill.

The committee recommends funding for staff in that it believes funding is crucial to the effectiveness of the committee. Act 184 of 1993, which created this committee, allows the committee to "employ the staff authorized by the General Assembly in the State General Appropriations Act for expenses of the committee." Currently, the committee has no funding for staff or expenses. Without funding and staff, issues cannot be effectively researched or studied and the committee will be unable to meet its mandate from the General Assembly to study all facets of the laws relating to crime and punishment and to review problems and concerns with the criminal justice system.

The committee recommends that funding be made available for a temporary, part-time clerical position to assist in the administration of committee functions and responsibilities. Also, the committee recommends that funding be made available to employ an attorney for the committee. An attorney is necessary to research the myriad of constitutional and other issues involved in the study of criminal law. The committee needs an attorney to advise the committee on criminal law, to draft proposed legislation, to track trends in the criminal justice system in the various states as well as nationally and to research these trends, and to generally be available to assist the committee in its work.

Also, the committee notes that the Sentencing Guidelines Commission will no longer exist as of July 1, 1994. The committee has drawn upon the resources of the commission, and believes that when the commission ceases to exist, there will be an even greater need to have an attorney available to study the various facets of the criminal justice system.

In closing, the committee looks forward to working with each of you as we continue to study all areas of criminal law and the criminal justice system.

Smith, Washington, Mescher, McGill and Matthews: A SENATE RESOLUTION TO CONGRATULATE COACH JOHN KRESSE AND THE COLLEGE OF CHARLESTON MEN'S BASKETBALL TEAM FOR AN OUTSTANDING 1993-94 SEASON AND THE GREAT HONOR OF RECEIVING AN AT-LARGE BID TO THE NCAA BASKETBALL TOURNAMENT AND TO WISH THEM THE BEST OF LUCK IN THE TOURNAMENT.

Whereas, the 1993-94 College of Charleston men's basketball team has received an at-large bid to the NCAA Basketball Tournament, a fantastic honor for a very deserving coach and team; and

Whereas, Coach John Kresse led the Cougars to a 19-8 winning season in their third full season as an NCAA member; and

Whereas, the Cougars finished with a sixteen-game winning streak, currently the nation's longest, a 24-3 record and the Trans America Athletic Conference Title; and

Whereas, Coach Kresse was TAAC's Coach of the Year with Marion Bushy named the conference's Player of the Year, the only time a first year TAAC team has claimed either honor; and

Whereas, Head Coach Kresse has won 364 games over fifteen seasons at the College of Charleston losing only 98, resulting in a .788 winning percentage; and

Whereas, receiving the at-large invitational bid to the NCAA is an outstanding tribute to the Cougars, to the superior coaching of Coach Kresse and his staff, and to the dedication and hard work of each and every Cougar player; and

Whereas, Coach Kresse, his staff, and the Cougar men's basketball team have brought great honor to the College of Charleston and the State of South Carolina and are to be congratulated for their NCAA Tournament bid and for a truly memorable season. Now, therefore,

Be it resolved by the Senate:

That the members of the Senate, by this resolution, congratulate Coach John Kresse and the College of Charleston men's basketball team for an outstanding 1993-94 season, its Trans America Athletic Conference title, and for the honor of receiving an at-large bid to the NCAA Basketball Tournament, and further, the members of the Senate wish the College of Charleston Cougars the best of luck in their NCAA Tournament play.

Amend the bill further, as and if amended, page 29, beginning on line 29, by striking SECTION 4 in its entirety and inserting therein the following:

/SECTION 4. Upon the effective date of this act, the Speaker of the South Carolina House of Representatives and the President Pro Tempore of the South Carolina Senate are jointly designated as the appropriate officials of the submitting authority who are responsible for making submissions of the congressional reapportionment plan set forth in this act to the Chief, Voting Section, Civil Rights Division, Department of Justice in compliance with Section 5 of the Voting Rights Act of 1965, as amended, and Title 28, Part 51 of the Code of Federal Regulations.

SECTION 5. This act takes effect upon approval by the Governor./

Statement by Senators WILSON and ROSE

We oppose the amendment adopted in Judiciary Committee which moved congressional district lines to accommodate prospective congressional candidates in Charleston County. We would support moving lines to address concerns of a community, but surgical line-drawing for particular individuals is inappropriate.

Boan: A BILL TO AMEND SECTION 1-11-730, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ELIGIBILITY TO PARTICIPATE IN STATE HEALTH AND DENTAL INSURANCE PLANS, SO AS TO CLARIFY THAT COVERAGE FOR A RETIREE WITH AT LEAST FIVE YEARS' SERVICE UNDER A STATE RETIREMENT SYSTEM IS LIMITED TO SERVICE IN A STATE-COVERED ENTITY AND TO REQUIRE THE LAST FIVE YEARS OF SUCH SERVICE TO HAVE BEEN CONSECUTIVE YEARS IN A FULL-TIME PERMANENT POSITION.

On motion of Senator PASSAILAIGUE, with unanimous consent, the Senate stood adjourned in honor of Coach John Kresse and the 1993-94 College of Charleston Men's Basketball Team for the great honor of receiving an at-large bid to the NCAA Basketball Tournament.
