A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-70 SO AS TO PROVIDE FOR THE ISSUANCE AND COST OF A DISTINGUISHING DECAL TO INDICATE THAT THE PERSON IN CONTROL OF A MOTOR VEHICLE CONSENTS TO ITS SEARCH FOR ILLEGAL DRUGS AND PROVIDE FOR THE SEARCH.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 56-5-70. The Department of Transportation shall issue a distinguishing decal upon request to a motor vehicle owner which when displayed indicates that the person in control of the vehicle and its passengers consent to its search for illegal drugs. It is not necessary that probable cause exists for a search to be conducted pursuant to this section. The decal must be designed by the department, must display information the department considers necessary for enforcement purposes, and must be placed on the inside of the windshield on the driver's side. The department may charge a fee for issuance equal to the cost of the decal."

SECTION 2. This act takes effect upon approval by the Governor.
