TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-1-130 SO AS TO PROVIDE THAT PHYSICAL ABUSE, SEXUAL ABUSE, MENTAL ABUSE, RACE, AND SEXUAL ORIENTATION MUST NOT BE USED AS A DEFENSE IN A CRIMINAL PROCEEDING.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 16-1-130. The following must not be used as a defense to the prosecution of a crime or offense:
(1) physical abuse;
(2) sexual abuse;
(3) mental abuse;
(4) race; and
(5) sexual orientation."
SECTION 2. This act takes effect upon approval by the Governor.
