A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-103-45 SO AS TO PROVIDE THAT THE COMMISSION ON HIGHER EDUCATION EACH FISCAL YEAR SHALL REDUCE THE FORMULA FUNDING TO STATE-SUPPORTED INSTITUTIONS OF HIGHER LEARNING THAT ACCEPT APPLICANTS BASED UPON GENDER AND TO PROVIDE FOR THE MANNER IN WHICH THE FORMULA FUNDING MUST BE REDUCED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 59-103-45. The Commission on Higher Education each fiscal year shall reduce in the manner provided in this section the formula funding to state-supported institutions of higher learning that accept applicants based upon gender. The commission shall determine the number of applicants eliminated from consideration in a particular year at the institution and reduce the formula funding of the institution for that year in direct proportion to the number of applicants disqualified. These funds shall be reserved in the manner the General Assembly shall provide in the general appropriations act to pay the educational expenditures of these applicants to attend any institution of higher learning in this State that meets the curriculum needs of the applicant."

SECTION 2. This act takes effect upon approval by the Governor.
