THE COMMITTEE ON JUDICIARY

To whom was referred a Bill (H. 3118), to amend the Code of Laws of South Carolina, 1976, by adding Section 2-1-216 so as to limit the terms of members of state boards, etc., respectfully

REPORT:

That they have duly and carefully considered the same, and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by striking Section 2-1-216 of the 1976 Code, as contained in SECTION 1 and inserting

/Section 2-1-216. No person may be appointed by the Governor or elected by the General Assembly to a state board or commission who has served two successive full terms, or twelve successive years, whichever is longer, on the board or commission. The limitation does not prevent a person from being elected or appointed to the same body after an absence of two years. This section does not apply to life members of the Clemson University Board of Trustees or to members of the Employment Security Commission or the Public Service Commission. Persons serving on these boards or commissions on July 1, 1995, may complete their then current term and thereafter serve two successive full terms or twelve successive years, whichever is longer./

A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 2-1-216 SO AS TO LIMIT THE TERMS OF MEMBERS OF STATE BOARDS AND COMMISSIONS APPOINTED BY THE GOVERNOR OR ELECTED BY THE GENERAL ASSEMBLY AND PROVIDE FOR EXCEPTIONS TO AND THE OPERATION OF THE PROVISIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 2-1-216. No person may be appointed by the Governor or elected by the General Assembly to a state board or commission who has served two successive full terms, or twelve successive years, whichever is longer. The limitation does not prevent a person from being elected or appointed to the same body after an absence of two years. This section does not apply to life members of the Clemson University Board of Trustees. Persons currently serving on these boards or commissions whose tenure exceeds the two-term or twelve-year limitation are permitted to complete their current term."

SECTION 2. This act takes effect July 1, 1995.
